Amendment 73 to Israel's Consumer Protection Law: businesses must now record sales calls — what it means for you

Passed in July 2026, in force eight months after publication. If you sell by phone, it applies to you — even if the whole business is one mobile.

What the law says

In July 2026 the Knesset passed Amendment No. 73 to the Consumer Protection Law — duty to record calls, keep them and deliver them to the consumer. It comes into force eight months from its publication in the Official Gazette (the ministers of economy and finance may delay it by up to four more months for particular sectors). Five duties:

  1. Record every sales call with a consumer when the transaction is sold by phone (remote marketing) and its total value is at least 750 ₪ — including related purchases from the same call, and for ongoing contracts by the annual payments or the contract-period total.
  2. Notify the customer at the start of the call that it is recorded and that they are entitled to a copy.
  3. Keep the recording at least two years if a transaction was concluded, at least six months if not.
  4. Deliver a copy to the customer within 10 business days of the request. The first copy is free.
  5. List the call dates on the invoice or billing statement.

Who it covers. Every phone sale worth 750 ₪ or more (food excepted), and — regardless of amount — the sectors the law names: telecom, internet and TV; tax-refund advice and medical-entitlement checks; credit-rating repair; maintenance and repair services; gas supply; loan brokerage and fund recovery; health services; mortgage advice. It is also applied to banks, insurers, pension advisers and credit companies.

What happens if you don't record

"I'm a sole trader with a mobile — how am I supposed to record?"

Most people the law touches do not sit in a call centre with a PBX. They are an insurance agent, a mortgage adviser, a gas technician, a salesperson — with a mobile. Here is how the four ways of recording measure up against the five duties:

The law does not distinguish by business size but by transaction type: a sale by phone (remote marketing) worth 750 ₪ or more, and certain sectors regardless. A sole trader closing deals by phone — probably yes. Check with a lawyer.

A transaction closed on a phone call with no face-to-face meeting — an outbound sales call, or a customer who calls and closes. The law lists sectors covered regardless: telecom, tax-refund and medical-entitlement checks, credit-rating repair, maintenance services, gas, loan brokerage, health services, mortgage advice, and more.

The duty is to say at the start of a sales call that it is recorded and the customer may have a copy. The wording does not distinguish who initiated the call. Safest: a fixed sentence at the start of every customer call.
